What This Means (2024 FDD)
According to Casiola's 2024 Franchise Disclosure Document, if a franchisee is an individual, their executor has 30 days from the date of death or permanent disability to appoint an Operating Manager approved by Casiola. Within 60 days of this appointment, the Operating Manager must complete Casiola's initial training program to the franchisor's satisfaction.
Furthermore, the Franchise Agreement must be transferred to a Casiola-approved transferee within 12 months of the date of death or disability, following the terms of the Franchise Agreement. If the franchisee is a Corporate Entity and the Managing Owner dies or becomes permanently disabled, the other Owners have 30 days to appoint a replacement Operating Manager, who must then complete the initial training program within 60 days of appointment.
This requirement ensures that the Casiola business continues to operate under approved management following the death or disability of the franchisee or Managing Owner. It also provides a defined timeframe for transferring the franchise to a qualified transferee, maintaining the standards and consistency of the Casiola franchise system. Prospective franchisees should consider these obligations when planning for business succession and estate planning.
