What This Means (2024 FDD)
According to Casiola's 2024 Franchise Disclosure Document, prospective franchisees in Hawaii must receive the Franchise Disclosure Document (FDD) at least seven days before the earlier of signing any binding agreement or paying any consideration related to the franchise. This requirement is mandated by the Hawaii Franchise Investment Law. This law makes it illegal to offer or sell any franchise in the state without providing the FDD and all proposed agreements to the prospective franchisee at least seven days before either the execution of any binding agreement or the payment of any consideration.
This seven-day review period allows potential Casiola franchisees adequate time to thoroughly review the FDD and seek professional advice before making any financial commitments or entering into a franchise agreement. The FDD contains crucial information about the franchise system, including fees, obligations, and financial performance.
Additionally, the disclosure document only contains a summary of certain material provisions of the franchise agreement, so prospective franchisees should refer to the contract or agreement for a full statement of all rights, conditions, restrictions, and obligations of both Casiola and the franchisee. Furthermore, any statement signed by a franchisee cannot waive claims under Hawaii franchise law or disclaim reliance on statements made by Casiola.
