What This Means (2024 FDD)

According to Casiola's 2024 Franchise Disclosure Document, the General Release does cover claims in admiralty law. The release encompasses a broad range of claims, including those related to admiralty law.

The General Release states that the franchisee releases Casiola from "any and all claims including, but not limited to Franchise Claims (defined below), causes of action, violations, damages, actions, contracts, covenants, promises, judgments, suits, indebtedness, liabilities, accounts, and demands of every kind and nature... whether in law, admiralty, common law, or equity." This means that any legal actions a franchisee might consider pursuing against Casiola under admiralty law are included in the claims being waived by the release.

This has significant implications for prospective franchisees. By signing the General Release, a franchisee gives up the right to sue Casiola for a wide array of issues, including those that fall under admiralty law. Franchisees should carefully consider the types of claims they might potentially have and whether they are comfortable waiving their right to pursue those claims. It is advisable to seek legal counsel to fully understand the scope and implications of the General Release before signing it.
