You will not receive an exclusive territory. You may face competition from other franchisees, from outlets that we own, or from other channels of distribution or competitive brands that we control. However, during the term of the Franchise Agreement, provided that you are not in default of your obligations to us or our affiliates and except as to our Reserved Rights set forth below, we will not open and operate and we will not grant another franchisee the right to open and operate a Casiola Business within your Operating Market.

What This Means (2024 FDD)
According to Casiola's 2024 Franchise Disclosure Document, a franchisee may face competition from other franchisees. While Casiola will not open or grant another franchise within a franchisee's Operating Market, this protection is conditional. It applies only if the franchisee is not in default of their obligations.
Several factors can lead to competition. Casiola can establish a Corporate Accounts Program, allowing other franchisees to service accounts within a franchisee's territory if the franchisee declines to participate. Additionally, Casiola retains significant rights, including the right to develop Casiola businesses outside a franchisee's Operating Market, irrespective of proximity.
Casiola also reserves the right to engage in or affiliate with other businesses, even those offering similar services, within a franchisee's Operating Market, as long as they do not use Casiola's Licensed Marks. These reserved rights and program structures create potential competitive scenarios for a Casiola franchisee.
