What This Means (2024 FDD)

According to the 2024 Casiola Franchise Disclosure Document, franchisees have specific advertising obligations. Casiola franchisees may be required to participate in an Advertising Cooperative if one exists in their operating market, and make ongoing financial contributions as determined by the cooperative. However, these contributions cannot exceed the franchisee's local minimum marketing obligations as outlined in Article 9.B of the Franchise Agreement, and contributions to the cooperative count toward fulfilling these minimum local marketing obligations.

The Advertising Cooperative is formed to administer marketing programs and develop media, all subject to Casiola's review and approval. Casiola retains control over the cooperative's foundational and organizational requirements, including voting provisions. Franchisees must also submit statements and reports as required by the Advertising Cooperative and approved by Casiola. All marketing materials, plans, or media used by the Advertising Cooperative or its members require prior written approval from Casiola.

Furthermore, Casiola franchisees must ensure that all advertising and promotion of their Franchised Business is factual, ethical, and conforms to Casiola's standards. Casiola retains the right to reject any advertising related to the Franchised Business, the System, or using the Licensed Marks. Franchisees must also refrain from any business or advertising practice that may be harmful to Casiola, the System, or the Licensed Marks.

These obligations ensure that Casiola maintains control over its brand image and marketing strategies, while also requiring franchisees to contribute to local advertising efforts. Prospective franchisees should carefully review Article 9.B of the Franchise Agreement to understand their minimum local marketing obligations and the potential costs associated with participating in an Advertising Cooperative.
