What This Means (2024 FDD)

According to the 2024 Casiola Franchise Disclosure Document, the Hawaii FDD Amendment supplements Exhibit J, which pertains to FDD Receipts. This means that Exhibit J is modified or added to with specific information or requirements that are relevant to franchisees operating in Hawaii.

For a prospective Casiola franchisee in Hawaii, this is an important consideration. The amendment includes specific statements that must be included in the receipt for the Disclosure Document in Hawaii. These statements cover key aspects of Hawaii's franchise investment law, including the fact that filing does not constitute approval by the state, the requirement to provide the disclosure document to the franchisee at least seven days before signing any agreement or payment, and that the disclosure document is only a summary of the franchise agreement.

Furthermore, the amendment clarifies that no statement signed by the franchisee can waive claims under Hawaii franchise law or disclaim reliance on statements made by Casiola. This provision supersedes any other term in any document executed in connection with the franchise, providing additional protection to the franchisee under Hawaii law. Therefore, prospective franchisees should carefully review Exhibit J and the Hawaii FDD Amendment to fully understand their rights and obligations under Hawaii franchise law.
