What This Means (2024 FDD)
According to the 2024 Casiola Franchise Disclosure Document, the franchisor has the exclusive right to determine the 'Assigned Areas' for Casiola businesses. An 'Assigned Area' refers to the operating area, designated area, or territory of current and future Casiola businesses, excluding the franchisee's own Operating Market.
This means that Casiola franchisees do not have control over the areas assigned to other franchisees or future businesses within the Casiola system. The franchisor retains the sole discretion to define these areas. This is a common practice in franchising, as it allows the franchisor to strategically manage market coverage and minimize potential conflicts between franchisees.
For a prospective Casiola franchisee, this underscores the importance of understanding the defined Operating Market and the potential for nearby Assigned Areas. While franchisees may have the opportunity to serve customers in open areas under certain conditions, these open areas can later become Assigned Areas, at which point the franchisee must cease serving customers in that area and turn over all related information to Casiola or another franchisee. This highlights the need for franchisees to focus their marketing efforts within their designated Operating Market and to be aware of the franchisor's control over territory assignments.
