What This Means (2024 FDD)
According to Casiola's 2024 Franchise Disclosure Document, if a franchisee fails to comply with Casiola's standards, systems, or specifications, they will generally have 30 days to cure the default. This cure period applies to situations where the franchisee fails to operate their Casiola Business in accordance with the specifications, standards, and requirements set forth in Casiola's Manuals or fails to operate the business in conformity with Casiola's System.
However, the 30-day cure period is not absolute. If the violation of federal, state, or local laws, rules, and regulations poses a threat to public health or safety, this cure period may not apply. Additionally, if the franchisee intentionally and knowingly refuses to comply with the terms of the Franchise Agreement, standards, specifications, or requirements, the default may be deemed non-curable.
It is important for prospective Casiola franchisees to understand the specific circumstances under which a default can be cured and those under which it cannot. Maintaining compliance with Casiola's standards, systems, and specifications, as well as all applicable laws and regulations, is crucial to avoiding defaults and potential termination of the franchise agreement.
