nd Guaranty (the "Agreement") is individually entered into by you as an owner of ____________________________ (hereinafter referred to as "Franchisee") and is delivered and signed by you in favor of Casiola Franchise LLC, franchisor of the Casiola franchise system and in favor of Casiola Franchise LLC's successors and assigns, upon the terms and conditions set forth in this Agreement. In this Agreement Casiola Franchise LLC is referred to as "us", "our" or "we", and each individual that signs this Agreement is referred to as "you".
Recitals and Representations
WHEREAS, Franchisee has entered into a Casiola Franchise Agreement (the "Franchise Agreement") for the development and operation of a Casiola Business (the "Franchised Business" or "Casiola Business") that offers and provides property rental, management, and maintenance services for vacation homes, shortterm rental properties, and related services and products designated by us, and related services and products (the "Approved Services and Products") under the Licensed Marks (defined below);
WHEREAS, you represent that you have received and have thoroughly reviewed the completed Franchise Agreement, including schedules and exhibits attached to the Franchise Agreement;
WHEREAS, we have recommended that you thoroughly review the Franchise Agreement, this Agreement and all schedules and exhibits to the Franchise Agreement with a lawyer selected and hired by you;

What This Means (2024 FDD)
According to the 2024 Casiola Franchise Disclosure Document, the Franchised Business offers property rental, management, and maintenance services for vacation homes and short-term rental properties. These services, along with related products, are designated as "Approved Services and Products." Casiola retains the exclusive right to determine these approved services and products, and may modify or supplement them based on their reasonable business judgment.
The Franchised Business is only allowed to offer and sell these "Approved Services and Products." This means a franchisee's ability to generate revenue is directly tied to the services and products that Casiola deems appropriate. Casiola also designates the "System Supplies" that must be exclusively utilized by the Franchised Business.
Furthermore, the FDD defines what constitutes a "Competitive Business," meaning any business that is the same as or similar to a Casiola Business, or any business that offers and/or provides property management services for short-term rental properties. This definition is important in the context of potential conflicts of interest or competitive activities by the franchisee. Casiola also utilizes organized communication systems and methods approved by Franchisor for communicating with property owners and end-user guest customers, called the "Contact Center".
