According to the 2024 Casiola Franchise Disclosure Document, Casiola has the discretion to use the Brand Development Fund for maintenance and upgrades to the System Website. Casiola's "System Website" is defined as the web page located at casiola.com, including all webpages, subdomains, and franchisee-specific pages associated with that URL.
Casiola maintains sole discretion over the strategic direction, creative concepts, and allocation of resources within the Brand Development Fund. This includes decisions related to advertising, media placement, marketing, and public relations programs. Casiola is not obligated to ensure that expenditures from the Brand Development Fund are proportionate to contributions from franchisees in any specific geographic area, nor is there a guarantee that any particular franchisee will directly benefit from the fund in proportion to their contributions.
Franchisees are required to participate in all advertising, marketing, and public relations programs instituted by the Brand Development Fund. Casiola Businesses owned by Casiola or its affiliates are not required to pay into the Brand Development Fund. The Brand Development Fund is not a trust, and Casiola is not a trustee or fiduciary of the fund, allowing Casiola to deposit and maintain the funds in its general accounts.
