According to Casa De Corazon's 2025 Franchise Disclosure Document, franchisees do not receive an exclusive territory and may encounter competition from various sources. This includes other Casa De Corazon franchisees, outlets owned by Casa De Corazon, alternative distribution channels, and competitive businesses that Casa De Corazon controls. This means that while you will have a 'Designated Territory,' Casa De Corazon can still operate or allow others to operate similar businesses nearby, as long as they don't use the Casa De Corazon name. They can also sell competitive goods and services through other channels like the Internet or catalogs, both inside and outside your territory.
Casa De Corazon retains significant flexibility in operating and expanding its business, which could directly impact a franchisee's market share and profitability. For example, Casa De Corazon can operate similar businesses within your Designated Territory as long as they do not operate under Casa De Corazon's marks. Furthermore, Casa De Corazon can sell products that you use in your center to anyone, regardless of their location. This broad latitude means that franchisees need to be prepared to compete actively within their designated area and potentially against the franchisor's other ventures.
It is important to note that Casa De Corazon can decrease the size of your Designated Territory if your center does not maintain a student enrollment of at least 90% of its actual capacity on a full-time equivalency basis after the second anniversary of opening. This creates a performance benchmark that franchisees must meet to maintain their territorial rights. Additionally, while franchisees can solicit clients outside their Designated Territory, they must obtain Casa De Corazon's approval for online or direct marketing efforts. All advertising materials and websites must also be approved by Casa De Corazon, ensuring brand consistency but also potentially limiting a franchisee's marketing autonomy.
