According to the 2025 Carvel Franchise Disclosure Document, when Carvel designates an Area of Protection for a franchised business, the franchisee must sign standard documentation prepared by Carvel. This documentation includes a general release to formally document the Area of Protection.

This means that a Carvel franchisee's protected territory is not simply assigned but requires a signed agreement, including a general release, to make it official. The Area of Protection applies to "Streetside Locations", which Carvel defines as freestanding, inline, and endcap locations on city streets or in shopping centers, excluding enclosed and open-air malls and outlet malls and centers.

If a Carvel franchisee relocates their franchised business, Carvel will specify a new Area of Protection for the new location, which will likely require similar documentation to be signed. Carvel retains the right to establish franchises and company-owned businesses offering similar products outside the Area of Protection, in "Other Locations" (such as airports, malls, and entertainment venues) inside or outside the Area of Protection, or in businesses other than Swirl Businesses inside or outside the Area of Protection, including co-branded locations with Cinnabon.
