What This Means (2025 FDD)
According to Carvel's 2025 Franchise Disclosure Document, a franchisee may incur additional expenses beyond the $5,000 inspection or analysis fee under specific circumstances. These additional costs can include the travel and living expenses of Carvel's inspectors or representatives during the inspection or analysis. Furthermore, the franchisee may be responsible for any other expenses Carvel incurs related to the inspection, including attorney's fees.
These charges are applicable if the franchisee has a repeat violation of operational suspension, fails to comply with required remedial measures, does not fully cooperate during the inspection or analysis, or repeats a previous violation. This means that maintaining compliance with Carvel's standards and requirements is crucial to avoid these additional costs.
It is important to note that these remedies and fees are not exclusive. Carvel retains the right to pursue other remedies outlined in the Franchise Agreement, including termination, for non-compliance. Therefore, a Carvel franchisee should prioritize adherence to all standards and provisions to avoid potential financial penalties and maintain a positive relationship with the franchisor.
