What This Means (2025 FDD)

According to the 2025 FDD, CKR (Carl Karcher Enterprises) has extensive rights regarding data retrieval from a Carls Jr. franchisee's computer systems. CKR, or its designee, has the right to retrieve any data, customer information, and other information from the franchisee's computers as they deem appropriate. This includes the ability to electronically poll daily sales, computer information, and other data from the franchised restaurants.

This access is described as "free and unfettered," meaning there are very few restrictions on what data CKR can access or how they can access it. The cost associated with this data retrieval is to be borne by CKR or the franchisor, Carl's Jr. Restaurants LLC, meaning the franchisee will not be directly charged for the data retrieval itself.

This arrangement has several implications for a prospective Carls Jr. franchisee. It allows Carls Jr. to closely monitor sales and operational data, which can be used to ensure compliance with brand standards, optimize marketing efforts, and provide support to franchisees. However, it also means that franchisees have very little control over what data is collected and how it is used. Franchisees are required to back up all data on their computer systems daily and comply with all operational requirements outlined in their Franchise Agreement and any governing manuals.
