What This Means (2025 FDD)

According to the 2025 Carls Jr. Franchise Disclosure Document, a franchisee who is provided access to Google Data through Olo is restricted in how they can use that data. Specifically, the franchisee may only use the Google Data to respond to queries from end-users that are received from Google products and services. This includes communicating with specific end-users identified by Google, such as processing or delivering a food order or issuing a refund.

In simpler terms, Carls Jr. franchisees can only use the Google Data to assist customers who have contacted them through Google services and who have placed a food order. This ensures that the data is used for customer service and order fulfillment purposes directly related to Google's platform.

Carls Jr. franchisees are also allowed to market to end users who have placed a food order, provided that the marketing is done via email and the end users have given Google consent to receive marketing from the franchisee. This allows for targeted marketing efforts towards customers who have already engaged with the brand through Google's services, but it requires adherence to Google's consent policies. This restriction helps protect consumer privacy and ensures that Carls Jr. franchisees use the data responsibly and ethically.

It is important to note that the franchisee does not have any rights to the Google Data itself. The rights are retained by Google. The franchisee's use is limited to the specific purposes outlined in the agreement with Olo, and any other use of the data is prohibited. This ensures that the franchisee's use of Google Data remains within the bounds of the agreement and protects the interests of both Google and the end-users.
