What This Means (2025 FDD)
According to the 2025 FDD, Carls Jr. has the right to change or modify the Carl's Jr. System. This includes modifications to the Operating Procedures Manual (OPM), the required training program, the menu and menu formats, and the required equipment. Carls Jr. can also make changes to the signage, the building and premises of the franchised restaurant, including the trade dress, décor, and color schemes.
Carls Jr. can also modify the presentation of the Proprietary Marks and adopt new administrative forms and means of reporting and payment of any monies owed to CJR, including electronic means. Furthermore, Carls Jr. can adopt and use new or modified Proprietary Marks or copyrighted materials. These changes are made at Carls Jr.'s discretion, and franchisees are obligated to comply with them.
For a prospective franchisee, this means that the Carls Jr. system is not static and can evolve over time. While this allows Carls Jr. to adapt to changing market conditions and customer preferences, it also means that franchisees must be prepared to invest in updates and changes to their restaurants to remain compliant with the franchise agreement. It is important for franchisees to stay informed about any upcoming changes and to budget accordingly for any necessary updates or modifications.
