What This Means (2024 FDD)
According to Carls's 2024 Franchise Disclosure Document, applicants and other individuals participating in the training programs are explicitly not considered employees or agents of CJR (Carl's Jr. Restaurants). This applies both during their participation in Discovery Day and the Training Programs, and upon termination of the agreement.
This means that these individuals are not entitled to any compensation, including salary, wages, or employee benefits, for their participation. Furthermore, they will not receive any reimbursement for costs and expenses incurred during Discovery Day or the Training Programs. Applicants and other individuals also waive any rights to damages, reimbursement of expenses, or payment of compensation related to their involvement in these programs.
This arrangement is typical in the franchise industry, where prospective franchisees often undergo training and evaluation periods before being granted a franchise. This ensures that Carls can assess the applicant's suitability without incurring employer obligations. It also places the onus on the applicant to bear the costs of their evaluation, which can be a significant factor in their decision to pursue the franchise opportunity.
