What This Means (2024 FDD)
According to Carls's 2024 Franchise Disclosure Document, Carls has no obligation to review any development proposal if the franchisee or their affiliates are not in full compliance with all agreements with Carls or its affiliates. This means that if a franchisee is in breach of any agreement, such as the Development Agreement or Franchise Agreement, Carls is not required to review any new site proposals.
This condition is significant for prospective franchisees because it emphasizes the importance of maintaining full compliance with all contractual obligations. Failure to do so can result in delays in the development process, as Carls is not obligated to review any new site proposals until the franchisee is back in compliance. This could potentially impact the franchisee's ability to expand their business according to their planned schedule.
Franchisees should ensure they understand and adhere to all terms and conditions outlined in their agreements with Carls to avoid any compliance issues that could hinder their development plans. This includes timely payments, adherence to operational standards, and fulfillment of any other obligations specified in the agreements. Maintaining open communication with Carls and addressing any potential compliance issues promptly can help franchisees avoid delays and ensure a smooth development process.
