Carls Franchise · 2024 FDD

Answer from 2024 FDD Document

Within 30 days after receipt of these documents, and any information which CJR may reasonably require, we will advise you in writing whether we have accepted a particular site; however, CJR has no obligation to review any development proposal if you or your affiliates are not in full compliance with all agreements with CJR or its affiliates. If we do not respond within that time period, we will be deemed not to have accepted the site.

What This Means (2024 FDD)

According to Carls's 2024 Franchise Disclosure Document, after receiving all required documents, Carls will advise a prospective franchisee in writing whether they have accepted a particular site within 30 days. However, Carls has no obligation to review any development proposal if the franchisee or their affiliates are not in full compliance with all agreements with Carls or its affiliates. If Carls does not respond within that 30-day period, the site will be deemed not to have been accepted.

This 30-day timeframe is a crucial consideration for prospective Carls franchisees as it dictates the pace of their site selection and development process. Franchisees need to ensure they promptly submit all required documents to Carls to initiate the review. Failure to comply with existing agreements could halt the site review process, potentially delaying the opening of the franchise.

The stipulation that a lack of response from Carls within 30 days constitutes a rejection of the site is also significant. Franchisees should maintain proactive communication with Carls during this period to confirm receipt of documents and clarify any potential issues. This proactive approach can help prevent inadvertent rejection of a site due to administrative delays or miscommunication.

Site selection is a critical factor in the success of a Carls franchise, and this clause underscores the importance of adhering to Carls's requirements and maintaining open communication throughout the approval process. Franchisees should factor this 30-day review period into their overall development timeline and be prepared to address any concerns raised by Carls promptly to avoid delays or rejection of their proposed site.
