What This Means (2024 FDD)

According to Carls's 2024 Franchise Disclosure Document, any Google Data accessed through Olo can only be used to respond to queries from end-users received from Google products and services. This includes communicating with specific end-users identified by Google, such as processing or delivering a food order or issuing a refund. Carls is specifically limited to using Google Data to assist end-users who have already placed a food order.

Carls is prohibited from using Google Data for any purpose other than assisting or marketing to end-users who have placed a food order. Even for marketing, it is restricted to email communication with end-users who have given Google consent to receive marketing from Carls. This means Carls cannot use the data for broader marketing campaigns or other forms of advertising without explicit consent.

These restrictions ensure that Carls respects user privacy and adheres to Google's terms of service. Carls must also avoid any automated, fraudulent, or invalid activity, and cannot use data scraping or extraction methods to collect information related to Actions on Google, unless expressly permitted by Google. Carls must also ensure that the information provided is accurate and up-to-date, and must not engage in deceptive or unethical practices.

For a prospective Carls franchisee, this means that while Google Data can be a valuable tool for customer service and targeted marketing, its use is heavily regulated. Franchisees must ensure they fully understand and comply with these restrictions to avoid violating the agreement and potentially facing penalties.
