For a Carls franchise, what condition must be met regarding the Franchise Management Training Program before the Franchised Restaurant can open?

According to Carls's 2024 Franchise Disclosure Document, before opening a franchised restaurant, certain employees must attend and successfully complete the Franchise Management Training Program (FMTP). Specifically, those employees hired by the franchisee to fill designated positions must complete the FMTP to the satisfaction of CJR, Carls's franchisor. This requirement is in accordance with Section 11.A of the franchise agreement.

The FMTP, as detailed in Section 11.A, includes classroom instruction and training at CJR's designated facilities or at a Carl's Jr. Restaurant designated by CJR. The franchisee, the General Manager, a minimum of 6 Shift Leaders, and any other designated employees must attend and satisfactorily complete each element of the FMTP. If the Franchisee's Operating Principal has not previously completed the FMTP, they must also attend and complete it satisfactorily. However, Carls reserves the right to modify or waive the training requirements based on an individual's or franchisee's experience.

This pre-opening training is a critical component of ensuring that the Carls franchise operates according to the franchisor's standards and procedures. Franchisees need to budget for the tuition fees, travel, living, and other expenses associated with sending their employees to the FMTP. Carls also retains the right to dismiss anyone from the training program who they believe will not perform acceptably, and the franchisee is responsible for providing a suitable replacement within one month. Meeting these training requirements is essential for receiving authorization to open the franchised restaurant.
