Under what circumstances can Caring Transitions modify a franchisee's territorial rights?
Caring_Transitions Franchise · 2025 FDDAnswer from 2025 FDD Document
If the Postal Service alters the boundary or number of the postal code(s) comprising your territory, we have the right to re-define the boundaries of your territory to correspond as nearly as possible to the original territorial border. Our decision on this matter will be final. There are no other circumstances that would permit us to modify your territorial rights.

What This Means (2025 FDD)
According to Caring Transitions' 2025 Franchise Disclosure Document, the boundaries of a franchisee's territory may be redefined if the Postal Service alters the postal codes that delineate the territory. In such cases, Caring Transitions has the right to adjust the boundaries to correspond as closely as possible to the original territorial border, and their decision on this matter is final.
However, the FDD explicitly states that there are no other circumstances that would permit Caring Transitions to modify a franchisee's territorial rights. This suggests that, barring postal code changes, the territory granted to a franchisee is intended to remain constant throughout the term of the franchise agreement. This provides a level of security and predictability for the franchisee's investment and business planning.
It is important to note that while Caring Transitions cannot modify the territorial rights, the exclusivity of the territory does not extend to National Accounts or shared referral sources. Additionally, Caring Transitions is not prohibited from operating or granting other franchises under different trademarks or trade names within a franchisee's territory, as long as these franchises are not "substantially similar" to a Caring Transitions franchise. These exceptions could potentially impact a franchisee's business, even though the territorial boundaries remain unchanged.
