What This Means (2025 FDD)
According to Caring Transitions' 2025 Franchise Disclosure Document, there are currently no agreements that significantly limit their rights to use or license their copyrights in any manner material to the franchise. Caring Transitions claims common law copyrights in its operations manuals, marketing materials, and other original works, retaining all rights and interests in these materials. Franchisees must use Caring Transitions' copyrighted materials, trademarks, or commercial symbols in advertising or promotion with appropriate notices.
Caring Transitions has developed systems for estate and household liquidation and moving management businesses, including pricing methods, management techniques, proposals, forms, specifications, procedures, knowledge, and expertise. This information, considered proprietary and confidential, is disclosed to franchisees in the operations manual, training seminars, and ongoing guidance. Franchisees are permitted to use this information solely for operating their franchised business during the franchise agreement term.
Franchisees cannot use the information in any other business, must maintain its confidentiality, and cannot make unauthorized copies of the operations manual or other written communications. They must also implement procedures to prevent unauthorized use or disclosure of the information. This indicates that while franchisees have access to copyrighted and proprietary information, their usage is strictly controlled and limited to the scope of their franchise agreement, with Caring Transitions retaining full ownership and control over its copyrights.
