What This Means (2025 FDD)

According to Caring Transitions's 2025 Franchise Disclosure Document, Caring Transitions will not solicit or accept orders inside a franchisee's exclusive territory. This means that Caring Transitions is prohibited from directly competing with its franchisees within their designated areas. This provides a level of protection for the franchisee, ensuring that the franchisor is not undermining their business by taking orders that would otherwise go to the franchisee.

However, this protection is not absolute. Caring Transitions may operate or grant franchises under different trademarks or trade names within a franchisee's territory, as long as these franchises do not offer services that are "substantially similar" to those of a Caring Transitions franchise. This implies that while Caring Transitions won't directly compete under the Caring Transitions brand, they could potentially introduce other brands that offer related, but not identical, services.

Furthermore, the exclusivity of a franchisee's territory does not extend to National Accounts, which are businesses or organizations with locations spanning multiple territories. Caring Transitions retains the exclusive right to service these National Accounts and can award the right to service them to any franchisee at its discretion. The territory also does not extend to "shared referral sources" such as attorneys or senior care facilities. Other Caring Transitions franchisees may solicit referrals from these sources located in your territory. These exceptions are important for prospective franchisees to consider, as they represent potential limitations on their exclusive territory rights.
