What This Means (2025 FDD)
According to Caring Transitions' 2025 Franchise Disclosure Document, franchisees must adhere to all applicable laws concerning the privacy of information collected from clients or other individuals. Franchisees must also comply with Caring Transitions' standards and policies related to privacy. If there is a conflict between these standards/policies and applicable law, the franchisee is obligated to follow the law, notify Caring Transitions of the conflict in writing, and fully cooperate with Caring Transitions to reconcile the differences.
Caring Transitions franchisees are solely responsible for understanding and complying with all privacy laws. They are not allowed to publish or implement a privacy policy without first obtaining written approval from Caring Transitions. This means franchisees need to stay informed about current privacy regulations and how they impact their business operations.
This requirement places a significant responsibility on the franchisee to ensure they are up-to-date with all relevant privacy laws, which can vary by location and may change over time. The franchisee must also seek legal counsel to ensure their Caring Transitions website complies with all relevant legislation and regulations. Obtaining Franchisor's written approval of the privacy policy is essential before implementation. This ensures that the franchisee's practices align with both legal requirements and Caring Transitions' standards, mitigating potential legal and reputational risks.
