What This Means (2025 FDD)
According to the 2025 FDD, the Caring Transitions franchise agreement does not explicitly detail the process or conditions under which the territory boundaries might be altered. However, the document does specify certain rights and restrictions regarding the franchisee's territory.
The FDD states that franchisees do not have an exclusive territory, with limitations on the franchisor's right to locate other Caring Transitions franchises. Franchisees are restricted from advertising or providing services in another franchisee's protected territory, and violations of these restrictions can lead to financial penalties. Specifically, a franchisee must remit all gross receipts earned from activities prohibited by this section of the agreement to the franchisor within 10 days of notice of the violation.
Prospective Caring Transitions franchisees should seek clarification from the franchisor regarding the conditions under which territory boundaries can be modified, the process for requesting territory adjustments, and any potential impact on their franchise operations. Understanding these aspects is crucial for assessing the long-term viability and growth potential of the franchise.
