What This Means (2025 FDD)

According to the 2025 Caring Transitions Franchise Disclosure Document, each principal grants the franchisor several powers and authorities. Principals grant Caring Transitions the authority to transfer, modify, cancel, or remove any service, listing, link, registration, or posting related to the franchise's online presence. This includes the ability to execute transfer documentation on the principal's behalf with various service providers, such as telephone, internet, email, domain registrars, online directories, communication providers, search engines, and regulatory agencies. This ensures that Caring Transitions can manage and control the franchise's online identity and presence.

Additionally, each principal grants Caring Transitions the authority to cancel, revoke, and remove any trade name, assumed name, fictitious name, business name, trademark, or equivalent registration filed in the principal's name if the registration includes the names CARING TRANSITIONS or any of the franchisor's other marks. This includes the power to execute and deliver any cancellation, termination, or modification requests and all other required documentation. This provision protects Caring Transitions' brand and trademarks by ensuring that no conflicting or infringing names or marks are used by the principal.

Furthermore, each principal grants Caring Transitions full power and authority to perform any and all acts and things that, in the franchisor's sole discretion, are necessary or advisable to carry out the purposes of this Power of Attorney. This essentially gives Caring Transitions broad discretion to act on behalf of the principal in matters related to the franchise. During the term of this Power of Attorney, no one dealing with Caring Transitions is required to verify the franchisor's authority or be responsible for the proper application of funds or property paid or delivered to the franchisor, or for the proper exercise of the authority granted to the franchisor. This clause aims to streamline operations and provide clarity to third parties dealing with Caring Transitions on behalf of the principal.
