What This Means (2025 FDD)
According to the 2025 Caring Transitions Franchise Disclosure Document, a franchisee's interest in confidential information and domain names/URLs is limited to the right to use them according to the franchise agreement. Caring Transitions retains ownership and control of all domain names and URLs related to any franchise, as well as all confidential information, electronic data, lists, and data related to past, present, and future clients of any franchise.
Caring Transitions franchisees acknowledge that the franchisor owns and controls all domain names and URLs related to any franchise, as well as all confidential information, electronic information, lists, and data related to past, present, and future clients of any franchise. The franchisee's only interest in any confidential information and any such domain names and URLs is the right to use it pursuant to the Franchise Agreement. Franchisees must maintain client lists in the Communication and Information System and make them available to Caring Transitions upon request. The ownership of the client list and all information in it belongs to Caring Transitions at all times.
This means that while franchisees operate their Caring Transitions business, they can use client information and online resources. However, they do not own this information, and their rights to use it are defined and limited by the franchise agreement. Upon termination of the agreement, the franchisee loses the right to use this information. This is a common practice in franchising, where the franchisor seeks to maintain control over brand assets and customer relationships.
Prospective franchisees should understand that they are essentially licensing the use of Caring Transitions's confidential information and online presence. They should carefully review the franchise agreement to understand the specific terms and conditions governing their use of this information and how it impacts their business operations. It is also important to note that franchisees must get approval from Caring Transitions before publishing or implementing a privacy policy.
