Can a Caring Transitions franchisee alter contracts provided by Caring Transitions that contain the Caring Transitions marks?
Caring_Transitions Franchise · 2025 FDDAnswer from 2025 FDD Document
Franchisee acknowledges and agrees that any and all copyrights in and to contracts, forms, advertising, marketing, promotional public relations, or sales concepts, plans, programs, activities, or materials proposed or developed by or on behalf of Franchisee that are used in the Franchised Business or that bear any of the Marks will be the sole property of Franchisor, and Franchisee shall execute such documents (and, if necessary, require its independent contractors to execute such documents) as may be deemed reasonably necessary by Franchisor to give effect to this provision.
Any such materials proposed or developed by Franchisee for the franchised business or the System and approved by Franchisor may be used by Franchisor and other Caring Transitions franchisees without compensation to Franchisee.

What This Means (2025 FDD)
According to Caring Transitions' 2025 Franchise Disclosure Document, franchisees cannot use the Caring Transitions marks outside the scope of the franchise agreement. The franchisee's right to use the marks is limited to operating the franchised business within the designated territory and as described in the agreement and the Manual.
The FDD states that any copyrights in contracts, forms, or advertising that bear any of the Caring Transitions marks are the sole property of Caring Transitions. Franchisees must ensure that any materials they propose or develop for the franchised business that bear the Caring Transitions marks are approved by Caring Transitions. If approved, Caring Transitions and other franchisees can use these materials without compensating the franchisee who developed them.
In practical terms, this means a Caring Transitions franchisee must use the marks as instructed by Caring Transitions and cannot unilaterally change contracts or other materials bearing the marks. Any alterations or modifications would need prior written approval from Caring Transitions, and any unauthorized use of the marks could be considered an infringement of Caring Transitions' rights. This is a fairly standard practice in franchising, as franchisors need to protect their brand identity and ensure consistency across all franchise locations.
