  • (b) Control. All employees engaged by Franchisee or other individuals who provide services to the Franchised Business or to its clients will be regarded as employees of Franchisee only and there will be no relationship between Franchisor and Franchisee's employees. What This Means (2025 FDD)

According to Caring Transitions' 2025 Franchise Disclosure Document, a franchisee must inform each employee in writing before they begin working that they are employed by the franchisee, not Caring Transitions. This requirement is designed to clarify the employment relationship and ensure that employees understand who is responsible for their employment terms and conditions.

This stipulation is important for legal and operational reasons. It helps to avoid any confusion about liability, workers' compensation, and other employment-related issues. By making it clear that the franchisee is the employer, Caring Transitions protects itself from potential legal claims or disputes involving the franchisee's employees.

For a prospective Caring Transitions franchisee, this means they must have a written notice prepared for all new hires, stating explicitly that the employee is working for the franchisee's business and not for the Caring Transitions franchisor. This is a straightforward requirement, but it is crucial for maintaining a clear and legally sound employment structure.
