What This Means (2025 FDD)
According to Caring Transitions' 2025 Franchise Disclosure Document, any System Standards that are communicated to the franchisee in writing are considered part of the franchise agreement. This means that if Caring Transitions provides a franchisee with a written standard, it holds the same legal weight as if it were originally included in the signed agreement.
This has significant implications for the franchisee. It allows Caring Transitions to modify and supplement the System Standards throughout the term of the agreement, and the franchisee is obligated to comply with these changes. These standards can include, but are not limited to, designated maximum or minimum amounts for a Buyer's Premium or for other Permitted Products and Services. The franchisee is bound by these changes as if they were part of the original agreement.
For a prospective franchisee, this highlights the importance of carefully reviewing all communications from Caring Transitions, as these could introduce new obligations or requirements. It also underscores the need to understand the scope and potential impact of the System Standards on the operation of the franchise. The franchisee must stay informed of any changes to the manual or other written communications from Caring Transitions to ensure compliance and avoid potential breaches of the franchise agreement.
