What This Means (2025 FDD)

According to Caring Transitions' 2025 Franchise Disclosure Document, the franchisor can redefine the boundaries of a franchisee's territory if the postal codes that define the territory are moved, altered, or eliminated. In such cases, Caring Transitions will redefine the territory to correspond as closely as possible to the original territory, using its sole discretion. This decision is final and binding on both the franchisor and the franchisee.

This clause protects Caring Transitions from being locked into outdated or inaccurate territory definitions due to changes in postal codes, which are common in growing or redeveloping areas. It ensures that the territory remains relevant and manageable. However, the franchisee has no control over this redefinition, as the franchisor's decision is final.

For a prospective Caring Transitions franchisee, this means that the territory defined in Exhibit B of the franchise agreement is subject to change. While the franchisor aims to maintain the original territory's essence, the franchisee should be aware that the exact geographical area could be altered. It would be prudent for a potential franchisee to discuss with Caring Transitions how territory redefinitions have been handled in the past and what criteria are used to ensure fairness and minimize disruption to the franchisee's business.
