Where will the arbitration proceedings take place for Caring Transitions disputes?

According to Caring Transitions' 2025 Franchise Disclosure Document, arbitration proceedings will occur in Hamilton County, Ohio. This means that if a franchisee has a dispute with Caring Transitions that goes to arbitration, the legal proceedings will be held in Hamilton County, Ohio, regardless of where the franchisee's business is located.

This requirement could create additional expenses for franchisees who do not live near Hamilton County, Ohio, as they would need to travel for hearings and other arbitration-related activities. These travel expenses are in addition to each party bearing their own costs and expenses in connection with the arbitration, including travel expenses, out-of-pocket expenses such as copying and telephone charges, court costs, witness fees, and attorney and accounting fees.

It is important to note that if the amount in controversy exceeds $100,000, Caring Transitions has the right to require the matter be adjudicated in either the Common Pleas Court of Hamilton County, Ohio or the United States District Court for the Southern District of Ohio, in lieu of arbitration.
