Can Caring Senior Service request a list of clients from the franchisee?

franchisee. At any time during the term of this Agreement, may request
from you, and you must provide us with, a list of these clients including the information we specify. Any noncompliance with the terms of this paragraph is a material breach under this Agreement.
If we engage in electronic commerce through any Internet, World Wide Web or other computer network site or sell through any other alternative distribution channel, and we receive requests for the Services or any other products or services offered by a Caring Senior Service Business calling for delivery or performance in your Protected Territory, then we will offer the request to you. If you choose not to fulfill the request or are unable to do so, then we, one of our affiliates or a third party designated by us (including another franchisee) may fulfill the order, and you will not be entitled to any compensation in connection with this.

What This Means (2025 FDD)
According to Caring Senior Service's 2025 Franchise Disclosure Document, Caring Senior Service can request a list of clients from its franchisees. During the term of the Franchise Agreement, Caring Senior Service may request a list of clients from the franchisee, including any information Caring Senior Service specifies. The franchisee is obligated to provide this list to Caring Senior Service when requested.
Additionally, all data and information collected from clients and potential clients in connection with the franchised business is owned by Caring Senior Service. Franchisees must grant Caring Senior Service unlimited access to this client data upon request. While the agreement is in effect, franchisees have a license to use the client data, but only in accordance with Caring Senior Service's policies and applicable law.
Franchisees are prohibited from selling, transferring, or using client data for any purpose other than operating their Caring Senior Service franchise in accordance with the Franchise Agreement. Failure to comply with these terms regarding client lists and data constitutes a material breach of the Franchise Agreement.
