You acknowledge that you do not have any right to deny the use of the Proprietary Marks to any other "Caring Senior Service" franchisees. In consideration therefor, you shall execute all documents and take such action as may be requested to allow us or other "Caring Senior Service" franchisees to have full use of the Proprietary Marks.

According to the 2025 Caring Senior Service Franchise Disclosure Document, franchisees do not have the right to deny the use of the proprietary marks to any other Caring Senior Service franchisees. As a franchisee, you must execute all documents and take action to allow Caring Senior Service or other franchisees to have full use of the Proprietary Marks. This means that Caring Senior Service is not obligated to protect a franchisee's right to use copyrights against other franchisees within the system.
To maintain consistent standards and protect Caring Senior Service's reputation, franchisees must conduct business and advertising using only the proprietary marks designated by Caring Senior Service. Franchisees are not allowed to use any other name for their business or advertising. Caring Senior Service retains the right to inspect a franchisee's business and operations at any reasonable time to ensure the proper use of proprietary marks. Franchisees are required to cooperate with and assist Caring Senior Service representatives during these inspections.
Franchisees must affix the appropriate copyright, registered trademark, or service mark symbols on all advertising, publicity, signs, and other printed or graphic materials that use the Caring Senior Service name or any other proprietary marks. If there is a claim of prior use of the Caring Senior Service name or any other proprietary marks in the franchisee's area, the franchisee must use Caring Senior Service's other proprietary marks in a way that avoids conflict, as determined by Caring Senior Service.
