You acknowledge that you do not have any right to deny the use of the Proprietary Marks to any other "Caring Senior Service" franchisees. In consideration therefor, you shall execute all documents and take such action as may be requested to allow us or other "Caring Senior Service" franchisees to have full use of the Proprietary Marks.

What This Means (2025 FDD)

According to the 2025 Caring Senior Service FDD, franchisees do not have the right to deny the use of proprietary marks to other Caring Senior Service franchisees. As a franchisee, you agree to execute all documents and actions that allow Caring Senior Service or its other franchisees to fully use the proprietary marks.

To maintain quality and protect the brand's reputation, Caring Senior Service requires franchisees to use only designated proprietary marks in their business and advertising. Franchisees cannot use any other name or the phrase "Caring Senior Service" (or any part of it) in their business's legal name, bank accounts, or financial connections.

Caring Senior Service retains the right to inspect a franchisee's business and operations to ensure the proper use of proprietary marks. Franchisees must also affix the appropriate copyright and trademark symbols (©, ®, ™, or SM) on all advertising, publicity, signs, and other materials that use the words "Caring Senior Service" or any other proprietary marks. If there is a claim of prior use of the Caring Senior Service name, the franchisee must use Caring Senior Service's other proprietary marks to avoid conflict, as directed by Caring Senior Service.
