Each Caring Senior Service® Business will need, at a minimum, an Agency Director, a Care Manager, and a Homecare Consultant. We recommend, but do not require, that you or one of your equity owners, if franchisee is a business entity, be either the Agency Director or Homecare Consultant for your Franchised Business.

If you are a business entity, each owner must sign a Continuing Guaranty substantially in the form attached as Attachment F to the Franchise Agreement. An owner's spouse is not required to sign a personal guaranty. The term "owner" means each individual or entity holding a direct or indirect beneficial ownership in the franchisee or developer. It includes all shareholders of a corporation, all members of a limited liability company, all general and limited partners of a limited partnership, and the grantor and the trustee of the trust, as well as each of their owners, if any.

ITEM 16 RESTRICTIONS ON WHAT THE FRANCHISEE MAY SELL

You must use the Franchised Business solely for the operation of the Franchised Business. You must keep your Franchised Business open and in normal operation for the minimum hours and days as we specify, subject to local law or the terms of your lease.

What This Means (2025 FDD)

According to the 2025 Caring Senior Service Franchise Disclosure Document, each Caring Senior Service business needs a minimum staff consisting of an Agency Director, a Care Manager, and a Homecare Consultant. The FDD recommends, but does not require, that the franchisee or one of their equity owners act as either the Agency Director or Homecare Consultant.

The Agency Director must complete the initial training program and devote their full time and best efforts to managing and operating the franchised business. Caring Senior Service has the right to approve or disapprove of the Agency Director based on their ability to meet the training requirements. The Agency Director and other key employees must sign an agreement not to reveal confidential information obtained during their employment.

If the franchisee or one of the owners elects to act as the Agency Director, they must still hire a Care Manager and Homecare Consultant before opening the franchised business. If the franchisee hires an Agency Director from the beginning, they must also hire a Care Manager and a Homecare Consultant. Each of these three positions must be held by different individuals. The number of staff members will likely increase as the business grows. For franchisees who own multiple Caring Senior Service franchises, Caring Senior Service may impose different or additional staffing requirements for the second and subsequent franchises.
