WHEREAS, we identify the System by means of certain trade names, service marks, trademarks, logos, emblems and indicia of origin, including, but not limited to, the mark "Caring Senior Service" and such other trade names, service marks, and trademarks as are now designated (and may hereafter be designated by us in writing) for use in connection with the System (hereinafter referred to as "Marks" or "Proprietary Marks");
WHEREAS, we continue to develop, use and control the use of such Marks in order to identify for the public the source of services and products marketed thereunder and under the System, and to represent the System's high standards of quality, appearance and service;

According to the 2025 Caring Senior Service FDD, the 'Marks' or 'Proprietary Marks' used to identify the Caring Senior Service system include trade names, service marks, trademarks, logos, emblems, and indicia of origin. Specifically, the mark "Caring Senior Service" is identified, along with other trade names, service marks, and trademarks designated by Caring Senior Service for use with the system. These marks are used to identify the source of services and products and represent the system's standards.
As a Caring Senior Service franchisee, you are granted a license to use these Proprietary Marks at the location specified in your agreement. You must identify yourself as an independent owner in conjunction with the use of the Proprietary Marks on items such as invoices and business stationery. You are also required to use the appropriate copyright and trademark symbols on any materials that use the Caring Senior Service name or other Proprietary Marks.
Caring Senior Service retains ownership of all Proprietary Marks, goodwill, and trade secrets. Franchisees cannot register or attempt to register the Proprietary Marks. Additionally, franchisees must get approval from Caring Senior Service before using Proprietary Marks on any materials, including signs and advertising. Franchisees must also comply with all laws regarding the use of fictitious or assumed names and register the trade name "Caring Senior Service" to operate under that name within their protected territory.
