Subject to the provisions of this Section 2.2, you shall have an option (exercisable only by written notice delivered to us less than nine (9) months, but more than six (6) months, prior to the end of the Initial Term of this Agreement) to renew the franchise hereunder for three renewal terms of five (5) years each, if:

Even though we decline the renewal of your franchise, it is possible that we can be required to renew it under a law, rule, regulation, statute, ordinance, or legal order that is applicable at the time. If that happens, to the extent it is allowed by the concerned law, rule, regulation, statute, ordinance or order, your renewal term will be subject to the conditions of the Franchise Agreement we are using for new franchisees at the time the renewal period begins. If we are not then offering new franchises, your renewal period will be subject to the terms in the Franchise Agreement that we indicate. If for any reason that is not allowed, the renewal term will be governed by the terms of this Agreement.

For the purposes hereof, you shall be deemed to have irrevocably elected not to renew the franchise hereunder (and the option to do so shall thereupon terminate) if you fail to execute and return to us our then-standard Franchise Agreement and other ancillary documents required by us for a renewal, together with payment of our renewal fee, within thirty (30) days after we have delivered them to you.

What This Means (2025 FDD)

According to the 2025 Caring Senior Service Franchise Disclosure Document, a franchisee has the option to renew their franchise agreement for up to three additional terms. Each renewal term is for a period of five years.

To exercise this renewal option, the franchisee must provide written notice to Caring Senior Service. This notice must be delivered no less than six months and no more than nine months before the end of the initial five-year term. This timeframe is important, as missing it could mean losing the opportunity to renew.

However, the ability to renew is contingent on meeting certain requirements. The franchisee must execute Caring Senior Service's then-current standard Franchise Agreement and any other required ancillary documents. Additionally, the franchisee must pay the renewal fee within 30 days of receiving the renewal documents. Failure to meet these conditions will result in the franchisee being deemed to have elected not to renew the franchise.

Even if Caring Senior Service declines to renew the franchise, there is a possibility that a law, rule, regulation, statute, ordinance, or legal order could require them to renew it. In such a case, the renewal term would be subject to the conditions of the Franchise Agreement that Caring Senior Service is using for new franchisees at the time the renewal period begins. If Caring Senior Service is not offering new franchises at that time, the renewal period will be subject to the terms in the Franchise Agreement that Caring Senior Service indicates.
