What This Means (2025 FDD)

According to the 2025 Caring Senior Service Franchise Disclosure Document, for franchisees in Illinois, the Franchise Agreement(s) are governed by Illinois law. This means that the interpretation and enforcement of the franchise agreement for Caring Senior Service locations in Illinois will be subject to the laws of Illinois.

This also means that certain provisions that might be standard in franchise agreements nationwide are modified to comply with Illinois-specific franchise laws. For example, the FDD states that any provision designating jurisdiction and venue outside of Illinois is void, although arbitration may occur outside of the state. Additionally, any attempt to waive compliance with Illinois franchise laws is void.

Furthermore, the Illinois Attorney General's Office has imposed a financial assurance requirement due to Caring Senior Service's financial condition. This requires the company to defer collecting initial franchise fees until the franchisee opens their business. These stipulations highlight the importance of understanding state-specific franchise laws and how they can impact the franchise agreement and the relationship between the franchisor and franchisee.
