In connection therewith, you shall from time to time abide by any reasonable requirement of ours with regard to the remodeling and upgrading of the Business to comply with standards then applicable to new "Caring Senior Service" franchisees. If at any time during the Initial Term or any renewal thereof any of the equipment and furnishings become obsolete or depreciated, then to the extent that they require replacement in accordance with our standards, you will replace the same with items required by our then-current standards and specifications. You shall not attach or exhibit any signs, displays, or posters on or in the interior of said building other than signs, displays or posters then currently supplied, required, or authorized in writing by us, nor shall you permit or suffer others to do so;

  • (c) operate the Business in accordance with the Confidential Operations Manual and strictly comply with the standards, specifications, requirements and instructions in the Confidential Operations Manual or as may be otherwise communicated to you by us. You must comply strictly with all standards, specifications, processes, procedures, requirements and instructions of ours, whether they now exist or are hereafter established from time to time regarding the operation of the Business. The Business and everything located therein must be maintained in first-class condition and repair and must be kept clean, neat and sanitary. It must be operated in a clean, wholesome and sanitary manner consistent with our requirements. All maintenance, repairs and replacements requested by us or needed in connection with the Business must be made promptly. All of your employees must be clean and neat and must wear the required uniform, if any, at all times, and must be properly licensed and qualified, if required by applicable law;

What This Means (2025 FDD)

According to the 2025 Caring Senior Service FDD, franchisees must, from time to time, adhere to any reasonable requirements from Caring Senior Service regarding the remodeling and upgrading of the Business to comply with the standards applicable to new Caring Senior Service franchisees. Franchisees are also responsible for keeping the premises, equipment, and furnishings in good condition and repair.

If any equipment or furnishings become obsolete or depreciated during the Initial Term or any renewal thereof, franchisees must replace them with items that meet Caring Senior Service's then-current standards and specifications. The Caring Senior Service franchise agreement specifies that the Business and everything within it must be maintained in first-class condition and repair, kept clean, neat, and sanitary, and operated in a clean, wholesome, and sanitary manner consistent with Caring Senior Service's requirements.

Caring Senior Service also reserves the right to modify various aspects of Caring Senior Service Businesses, including design, format, color, trade dress, signage, commercial symbols, décor, products, and services. Franchisees agree to comply with these changes within the time frames specified by Caring Senior Service. However, Caring Senior Service affirms that franchisees will not be required to perform major remodeling or redecoration of the Business more often than once every five years. All changes made to the Business are at the franchisee's sole cost and expense. All maintenance, repairs, and replacements requested by Caring Senior Service or needed in connection with the Business must be made promptly.
