What This Means (2024 FDD)
According to Care Plus Medical Ucc's 2024 Franchise Disclosure Document, a franchisee is restricted from associating with charitable, political, religious, or other organizations in the name of the business without prior written approval from Care Plus Medical Ucc. This restriction applies to both donating money, products, or services and acting in support of such organizations. However, Care Plus Medical UCC's approval will not be unreasonably withheld.
This policy ensures that the Care Plus Medical Ucc brand maintains a consistent image and avoids association with causes that may be controversial or misaligned with the company's values. It gives Care Plus Medical Ucc control over how its franchisees engage with the community and prevents franchisees from making independent decisions that could impact the brand's reputation.
For a prospective franchisee, this means that any involvement with external organizations through the Care Plus Medical Ucc business requires prior authorization. While Care Plus Medical Ucc states that approval will not be unreasonably withheld, franchisees should be prepared to justify their proposed associations and provide sufficient information for Care Plus Medical Ucc to make an informed decision. Franchisees should factor in the time required to obtain approval when planning any community engagement activities.
This type of clause is relatively common in franchise agreements, as franchisors seek to protect their brand image and ensure consistent messaging across all franchise locations. Franchisees should carefully consider these restrictions and ensure they align with their own values and community involvement goals before entering into a franchise agreement with Care Plus Medical Ucc.
