What This Means (2024 FDD)
According to Care Plus Medical Ucc's 2024 Franchise Disclosure Document, Care Plus Medical Ucc has the right to vary or waive any System Standard for individual franchises. This flexibility is not extended to the franchisee, meaning they cannot request such variations or waivers themselves.
Care Plus Medical Ucc may implement these variations due to specific factors related to the franchise location or its operating environment. These factors include the peculiarities of the site, population density, business potential, the population of the trade area, existing business practices, and applicable laws or regulations. Any other condition relevant to the performance of a franchise or group of franchises can also be a reason for Care Plus Medical Ucc to vary or waive System Standards.
This clause in the franchise agreement allows Care Plus Medical Ucc to adapt its System Standards to suit the unique circumstances of different franchise locations. However, it also means that franchisees do not have the same right to request variations, potentially creating an imbalance in operational flexibility. Prospective franchisees should consider this when evaluating the franchise agreement and discuss with Care Plus Medical Ucc what specific conditions might warrant a variation in System Standards for their location.
It is common for franchisors to retain the right to modify system standards to adapt to changing market conditions or local requirements. However, franchisees should seek clarity on how these variations are determined and implemented to ensure fair and consistent application across the franchise system.
