What This Means (2024 FDD)
According to Care Plus Medical Ucc's 2024 Franchise Disclosure Document, several policies could potentially impact a franchisee's access to customers. Care Plus Medical UCC retains ownership of all customer data generated by the franchisee's business, licensing it back to the franchisee solely for use during the term of the agreement. This means that upon termination or expiration of the franchise agreement, the franchisee loses the right to use this customer data.
Care Plus Medical UCC also has the right to take action to resolve customer complaints and can require the franchisee to reimburse Care Plus Medical UCC for any expenses incurred in resolving these complaints. Franchisees must participate in customer evaluation and compliance programs, potentially including customer feedback systems, surveys, and mystery shopping, and meet minimum score requirements set by Care Plus Medical UCC, including scores on internet review sites. Failure to meet these requirements could lead to default under the agreement.
Furthermore, Care Plus Medical UCC mandates that franchisees accept payment from customers in forms designated by Care Plus Medical UCC, which may include specific credit/debit cards, gift cards, and mobile payment systems. Care Plus Medical UCC can also require franchisees to participate in gift card, loyalty, and incentive programs. While a franchisee is in default, Care Plus Medical UCC can stop providing products and services to the franchisee and request that third-party vendors do the same.
These stipulations grant Care Plus Medical Ucc significant control over customer interactions, data, and payment methods, which could indirectly restrict a franchisee's access and influence over their customer base. A prospective franchisee should consider how these controls might affect their ability to build customer relationships and manage their business effectively.
