What This Means (2024 FDD)
According to Care Plus Medical Ucc's 2024 Franchise Disclosure Document, the franchisee is solely responsible for all employment-related decisions and conditions within their Care Plus Medical Ucc business. This encompasses recruiting, hiring, training, scheduling, supervising, compensating, and terminating personnel. Care Plus Medical Ucc may offer suggested staffing levels and guidelines for hiring, as well as training programs for new employees, but the ultimate decisions rest with the franchisee.
Care Plus Medical Ucc may set minimum qualifications for certain employee categories and can require the Principal Executive or other employees to complete training programs. The franchisee is responsible for all costs associated with such training, including travel and lodging expenses. The franchisee must also ensure that all personnel provide competent and courteous service and comply with appearance and hygiene standards outlined in the manual.
The FDD emphasizes that the franchisee and Care Plus Medical Ucc are not joint employers. The franchisee is responsible for all actions of its personnel. To reinforce this, Care Plus Medical Ucc may require the franchisee and its employees to sign an acknowledgment form confirming that the franchisee alone is the employer. The franchisee must use its legal name on all employment-related documents and cannot use Care Plus Medical Ucc's trademarks on these documents.
This arrangement is typical in franchising, where franchisees operate as independent business owners. It means that the franchisee bears the full responsibility and liability for all employment-related matters, including compliance with labor laws and regulations. Prospective franchisees should carefully consider these responsibilities and ensure they have the necessary resources and expertise to manage their workforce effectively.
