Who provides the services at a Care Plus Medical Ucc Franchised Business?

Care_Plus_Medical_Ucc Franchise · 2024 FDD

Answer from 2024 FDD Document

The franchise operates under the "Care Plus Medical UCC" service mark providing counseling, medication management, and therapeutic products and services, by Licensed Providers, to individuals, couples, families, and groups. These businesses are referred to in this Disclosure Document as a "Franchised Business". A "Licensed Provider" means, as applicable: (1) a counselor or therapist licensed to provide medical products and services, directly or indirectly, at or through your Franchised Business under applicable local, state, and federal laws and regulations; and (2) a prescriber providing evaluation and management services that is licensed to prescribe medication to patients, directly or indirectly, at or through your Franchised Business under applicable local, state, and federal laws and regulations. We offer 2 paths for the ownership, development, and operation of a Franchised Business, depending on the qualifications of the franchisee and the applicable local, state, and federal laws and regulations— Direct Ownership Model and Managed Operation Model, as discussed below. Regardless of the development path for your Franchised Business, all medical products and services provided through your Franchised Business must be provided by Licensed Providers, and you are solely responsible for ensuring that the ownership, development, and operation of the Franchised Business complies with all applicable local, state, and federal laws and regulations. In either case, the Franchised Business must be operated under the "Care Plus Medical UCC" service mark and logo and other trademarks, trade names, service marks, and commercial symbols we may authorize (the "Marks").

What This Means (2024 FDD)

According to Care Plus Medical Ucc's 2024 Franchise Disclosure Document, the services at a Franchised Business are provided by Licensed Providers. The FDD defines a "Licensed Provider" as a counselor or therapist licensed to provide medical products and services, or a prescriber licensed to prescribe medication to patients. These services are offered to individuals, couples, families, and groups.

Care Plus Medical Ucc offers two ownership models: the Direct Ownership Model and the Managed Operation Model. Regardless of the model, all medical products and services must be provided by Licensed Providers. The franchisee is responsible for ensuring compliance with all applicable laws and regulations.

Under the Direct Ownership Model, the franchisee must either be a Licensed Provider themselves or operate in a state that permits non-licensed individuals to own such businesses. In the Managed Operation Model, the franchisee provides management services to a Practice Entity, which is operated by Licensed Providers. The franchisee is responsible for the construction of the Franchised Business and ensuring the Practice Entity operates in accordance with Care Plus Medical Ucc's standards. However, only the Licensed Providers are permitted to exercise professional or medical judgment and offer medical products or services.

Prospective franchisees should be aware of the legal and regulatory landscape, including the corporate practice of medicine doctrine, which may require medical services to be provided through a professional entity owned by licensed medical professionals. Franchisees must ensure that all individuals providing counseling and therapy products and services are properly licensed and certified, and that non-licensed professionals do not influence medical service delivery.
