What This Means (2024 FDD)

According to Care Plus Medical Ucc's 2024 Franchise Disclosure Document, the Guarantor waives the right to receive notice of acceptance of the Guaranty. The guarantor unconditionally guarantees that the franchisee will fulfill all obligations outlined in the Franchise Agreement, including payments and performance.

Upon demand from Care Plus Medical UCC, the Guarantor must render any payment or performance required under the Franchise Agreement or any other agreement between the franchisee and Care Plus Medical UCC. This means that if the franchisee fails to meet their obligations, Care Plus Medical UCC can immediately seek fulfillment from the Guarantor without prior notice.

In addition to waiving the acceptance and notice of acceptance, the Guarantor also waives other rights, including notice of demand for payment, notice of default, and any right to require Care Plus Medical UCC to first pursue action against the franchisee. This comprehensive waiver strengthens Care Plus Medical UCC's position by allowing them to directly pursue the Guarantor for any breaches or non-performance by the franchisee, ensuring a more streamlined process for the franchisor.
