What This Means (2024 FDD)

According to Care Plus Medical Ucc's 2024 Franchise Disclosure Document, a notice is considered effective upon receipt or first rejection. To be valid, the notice must be in writing and delivered according to specific methods outlined in the agreement. These methods include personal delivery, registered or certified U.S. mail with return receipt requested, or overnight courier service.

For a Care Plus Medical Ucc franchisee, this means that important communications, such as those regarding breaches of contract or changes to system standards, are only officially recognized once they have been received and acknowledged, or if delivery was attempted and refused. This places a responsibility on both Care Plus Medical Ucc and the franchisee to ensure that contact information is up-to-date and that they have systems in place to properly receive and respond to formal notices.

However, there is an exception to the standard notification process. Care Plus Medical Ucc retains the right to amend the Manual, provide binding notice of changes to System Standards, and deliver notices of default via electronic mail or other electronic communication. This exception gives Care Plus Medical Ucc more flexibility in how it communicates certain types of information, potentially expediting the process and ensuring that franchisees are promptly informed of important changes or issues.
