What This Means (2024 FDD)
According to Care Plus Medical Ucc's 2024 Franchise Disclosure Document, the Marketing Fund Contribution, which is 1% of gross sales, is due weekly on Tuesday. The amounts due will be withdrawn by electronic wire transfer from the franchisee's designated bank account. Gross sales are defined as the total dollar amount of all sales generated through the business, including payments for services or products sold, whether for cash or credit. However, gross sales do not include bona fide refunds to customers, sales taxes collected, the sale of used equipment not in the ordinary course of business, or sales of prepaid cards or similar products (though the redemption of such cards or products will be included in gross sales).
Care Plus Medical Ucc also requires franchisees to pay royalty fees and other amounts due via preauthorized bank draft, but they can require an alternative payment method. All fees are payable only to Care Plus Medical Ucc, other than local marketing and software subscription charges, and are imposed and collected by them. All fees are non-refundable and uniform for all franchisees, although Care Plus Medical Ucc reserves the right to change, waive, or eliminate fees for any one or more franchisees as they deem appropriate.
If a franchisee fails to make a required payment when due, Care Plus Medical Ucc may charge a late fee of $100 plus interest on the unpaid amount at a rate equal to 18% per year (or the highest rate allowed by law, if lower). They may also charge a $30 fee (or the maximum allowed by law, if lower) for any returned payments. Additionally, if Care Plus Medical Ucc pays any amount that a franchisee owes to a third party, the franchisee must reimburse them, adding a 10% administrative fee for non-compliance cure costs.
