What This Means (2024 FDD)
According to the 2024 Care Plus Medical UCC Franchise Disclosure Document, Care Plus Medical UCC has the right to modify the Manual at its discretion and may inform franchisees of these changes through any method it deems appropriate. This method does not have to qualify as formal "notice." In the event of a dispute, Care Plus Medical UCC's master copy of the Manual will be the controlling document.
This means that Care Plus Medical UCC has broad authority to update its operational guidelines and is not obligated to provide franchisees with specific advance notice of these changes. Franchisees are responsible for staying current with the Manual's requirements, and the franchisor's version will be considered the definitive source.
Prospective franchisees should be aware of this provision, as it places the onus on them to regularly check for updates and adhere to any new standards implemented by Care Plus Medical UCC. It would be prudent to inquire about the typical frequency and methods of communication used for Manual updates during the due diligence process to better understand how these changes are disseminated.
